Privacy Policy

Your privacy is very important to us, and a top priority for every member of the NDUR Community. The NDUR Community is a safe and judgement free space for athletes to connect anonymously, and join in authentic and open communication. The NDUR Community brings athletes together, bound by the passion for sports, to support each on their journeys.

Please review this Privacy Policy to find out what and how we collect and use your personal information. We encourage you to read this Privacy Policy and to use it to make informed decisions. The Privacy Policy is hereby incorporated by reference into our Terms of Use.

This Privacy Policy governs your use of the software application NDUR (“Application”) for mobile devices, that was created by Xinteractive, Inc. The Application is used for college level student athletes to match-up and connect with each other, as well as with mentors, and for other informational purposes and resources. It is also used by colleges, by the NDUR team, and other 3rd parties to communicate with you. By using the NDUR mobile app you are opting in to receiving communications and information from: your peers (other college athletes), mentors (former college athletes, and others), colleges, universities, and other 3rd parties.

This Privacy Policy DOES NOT apply to information that we collect offline or on any other apps or websites, including websites you may access through this Application or is collected by any third party.

WHAT INFORMATION DOES THE APPLICATION OBTAIN AND HOW IS IT USED?

NDUR collects and stores data provided by you and your school. This may include your name, email address, graduation year, sport, conference, gender, ethnicity, and orientation.  At no time will we sell, share or distribute any of this personally identifiable information with any 3rd parties.

ANONYMITY

All communications that occur in the application between users (and/or mentors) are 100% anonymous. At no time will your profile information ever be exposed to another member of the NDUR community, or to members of the mentor network.

MONITORING

NDUR reserves the right to monitor all communications and content within the application. At no time will the content of the communications between users of the application be shared with your school, or any 3rd party. However, at any time it is determined that a user of the application is of concern, or at risk, it is at the discretion of the NDUR counseling team to assess the content, and determine the best course of action, which may include suspension of the user account, recommendations, or alerts provided to your school’s counseling team. If it is determined that there is a moment of crisis, either discovered by the NDUR team, or reported by another user of the application, we reserve the right to notify your school including your name, and email address. WHAT ARE MY OPT OUT RIGHTS?

You can close your user account and stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

USER PROVIDED INFORMATION

During registration, you will provide (a) email address, name, graduation year, sport, and you will set a password of your choice. (b) you may also choose to provide us other information such as: gender, ethnicity, and orientation, all at your own discretion (c) transaction-related information, when you register for an event, respond to any offers, make purchases, or download or use applications from us; (d) information you provide us when you contact us for help; (e) credit card information for purchase and use of the Application (if applicable), and; (f) information you enter into our system when using the Application, such as contact information and project management information.

We use this information to send you relevant information recommended by your school, and other third parties, that match your interests, and profile information. You may also provide us with your informed consent to receive additional product and service information from NDUR or directly from our partner colleges, universities and partner companies. We may also use the information you provided us to contact you from time to time to provide you with important information, required notices and other marketing promotions.

We may also collect contact and other information from you, and share it with colleges and other 3rd parties if you: (1) participate in one of our events, contests or sweepstakes or apply for a scholarship from us; (2) order from us; (3) take part in one of our surveys or quizzes; (4) contact us; or (5) otherwise voluntarily submit information to us, including in our online and social communities.

From time to time, we also use a QR code as a mechanism to automatically route you from another location such as a website, SMS or email directly to the App Store or Google Play Store to install our mobile app.

In addition, we may collect information about your browsing behavior, such as the date and time you visit our mobile application, the areas or pages of the mobile application that you visit, the amount of time you spend viewing the mobile application, the pages, the number of times you return to the mobile application, and other click-stream data. We do not combine this non-personal information with your personal information. We use this information to: (1) provide you with customized content from NDUR, colleges, and other third parties, as well as promotional and advertising content; (2) administer the mobile application, monitor its usage and diagnose problems with it; (3) remember you when you return to the mobile application, so that you don’t have to re-submit information and preferences; and (4) conduct research to improve our content and services. In addition, we use software that uses your IP address to determine roughly where you are located, so that we can deliver customized content from colleges and other third parties, as well as promotional and advertising content to you, based on your location and therefore as relevant to you as possible.

REAL TIME LOCATION

When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within, and roughly where you are located, display a location map with relevant advertisements, and send you messages based on your location

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

CONTENT SERVED OR ENHANCED BY NDUR

Our goal is to deliver content to you that is valuable. This delivery of information, advertisement, or other commercial or sponsored content from colleges or other third parties may be delivered to you in the form of Email, SMS Message, or Push Notifications (in-app messaging). We collect data and measure the effectiveness of our push notification campaigns, by measuring whether the messages have been received, opened or otherwise acted upon.

We may also work with a company that serves content on our behalf. The company uses cookies, web beacons or similar technologies to collect anonymous information about your visits to the mobile application and other websites, so that we may serve you content that is relevant to your interests. Our ad serving company does not collect personal information about you, and we do not share any personal information with it.

We will never share your IP address with a third party (except for our service providers) without first securing your express permission to do so.

LINKS

The mobile application hosts numerous links to other sites, which are provided for your convenience only. We have no control over these linked sites, all of which have their own privacy policies and terms of use. You access them at your own risk. Inclusion of any linked third-party site on the Site does not imply our approval or endorsement of the site. This includes sharing or posting of any NDUR information on other third party sites.

AUTOMATICALLY COLLECTED INFORMATION

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

YOUR RIGHTS AS A DATA SUBJECT

The EU GDPR (General Data Protection Regulations) makes provisions for the treatment of personal data and associated rights by EU citizens. The California Consumer Privacy Act (CCPA) makes provisions for the treatment of personal data and associated rights by California citizens.

At Xinteractive, Inc, in addition to our compliance with these regulations with regards to EU citizens and California citizens, as a matter of good governance and accountability, we are extending the same rights to all of our data subjects.

You can ask us what information we hold about you, and can ask us to correct it if it is inaccurate. If we have asked for your consent to process your personal data, you may withdraw that consent at any time. If we are processing your personal data for reasons of consent or to fulfill a contract, you can ask us to give you a copy of the information in a machine-readable format so that you can transfer it to another provider. If we are processing your personal data for reasons of consent or legitimate interest, you can request that your data be erased. You have the right to ask us to stop using your information for a period of time if you believe we are not doing so lawfully.

THIRD PARTIES

Yes. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a court order, subpoena, or similar legal process;

  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

  • To enforce or apply our Terms of Use

  • To our subsidiaries and affiliates.

  • To contractors, service providers and other third parties we use to support our business.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about our Application users is among the assets transferred.

  • To fulfill the purpose for which you provide it.

DATA RETENTION POLICIES, MANAGING YOUR INFORMATION

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at: supportteam@ndurforathletes.health and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

CHILDREN UNDER THE AGE OF 13

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at: info@collegeinteractive.com. We will delete such information from our files within a reasonable time.

​Any use of or access to the Service by anyone under the age of 13 is not permitted and violates our Terms of Use. By using or accessing our Service, you represent and warrant that you are 13 years of age or older and fully able to enter into and abide by all of our Terms. We may terminate your User Account and delete any profiles, content or data you may have created or provided if we believe, in our sole discretion, that you are less than 13 years old.

SECURITY

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

CHANGES

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or push notification. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

YOUR CONSENT

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
